The fine line between self-defense and murder

Laveen, Arizona (CNN) -- Daniel Adkins Jr....who was 29 but had the mental capacity of a 13-year-old, had been shot and killed. The shooter said he acted in self-defense. He has not been charged.

A gun bill...[commonly] called "Make my Day," it says people have no duty to retreat before using deadly force to protect themselves anywhere they have the legal right to be.

Daniel Adkins Jr. walked past Taco Bell's drive-thru just as a 22-year-old man pulled around in his SUV to pick up his order. Sitting in the passenger seat was his pregnant fiancée.

The driver slammed on the brakes, just missing Adkins. The two men exchanged words.

The shooter told police that Adkins "air swung" his hands in the direction of the SUV, but acknowledged he never hit him or his vehicle. Still, he said, he was afraid of what Adkins might do with the weapon he believed he was carrying. Although a weapon was never found, the shooter described it as a 3-foot metal pipe or bat.

When Adkins lifted his hands in the air again, the driver drew his Smith and Wesson .40-caliber handgun from his sweatpants. He pointed the barrel at Adkins and racked the slide of the gun, putting a bullet in the chamber. Then he pulled the trigger. Struck in the chest, Adkins fell to the ground, face first.

He told police he had no choice but to shoot. He said he couldn't drive away from Adkins because the dog was in the way and he "thought he had no other options," according to the police report.

While the shooter said he did not believe Adkins would have killed him and his fiancée had he not fired, he also said he feared Adkins was trying to hurt him."

While there is a fine line between self Defense and Murder... that is why we have a legal system to help in determining the difference.
It is very easy to pull out a situation where the use of a firearm might be muddled in the use of self defense... how many times has it been used appropriately in a self defense scenario?

I would rather have the ability to determine for my self (and then in front Judge and Jury if necessary) what constitues my own self defined line that I am not willing for someone to cross - than to not have the option at all.

It used to be (before any stand your ground laws) that you had to retreat. If I am with my GF, or daughter... that retreat may not be possible. I am fat, old, arthirtic, and can not "run" to save my ass let alone my family. There are others who are wheel chair bound that can NOW say...this is my line, and I can not be expected to retreat any further. additoionally, in the cases where rape is imminent...the victim doesn't have to run to the alley .. or another side of the alley in retreat... this is where I make a stance. THis is MY line you may not cross... I am armed. I am accountable.


If that line is crossed, I make the determination on the use of lethal force. I will need to account for my actions and live with the consequences (the fact that I took a life is not an easy thing to come to term with OR a prison sentence for that matter).

What I take most objection to is that even after (assumption here) a person is aquitted (sp) they can still face civil prosecution that was otherwise ruled a valid use of lethal force. In many states, this is still the case. That should be changed. If I did not act in a criminal manner in defending life, then I should not be able to be sued civillay for damages.

I carry a gun for the same reasons I have a seat belt in my car and a fire extinguisher in my house. I hope to god (whichever one you like... or none at all) I may never need the use of these life saving devices... but I am sure glad when the time comes that their use can save me or my family.
